How the fee is determined
Unless agreed otherwise, the Lawyers' Remuneration Act (RVG) applies. In employment and civil matters the fee is determined by the value in dispute and by the nature and extent of the work involved. Detailed information is available from the German Federal Bar.
I.Statutory feeUnder the RVG, based on the value in dispute. This is the usual basis in employment, civil and family matters.
II.Fee agreementAn hourly or flat fee where that is easier for you to budget, for example in criminal matters.
III.Fixed-fee serviceFor clearly defined services. Price and scope are agreed in advance.
Who pays in the end?
Three things worth knowing beforehand01Employment law, first instance§ 12a Abs. 1 Satz 1 ArbGGBefore the labour court, each side bears its own legal costs at first instance, even if you win. Legal expenses insurance is therefore particularly worthwhile here.
02Legal expenses insuranceI handle the coverage requestLarge parts of employment and civil law are covered; in criminal law usually only negligence and regulatory offences. As a rule only the statutory fees are insured, often with an excess. Bring your policy number and I will handle the coverage request.
03Legal aidEmployment and civil proceedingsIf your income is low and the case has prospects of success, the court treasury advances court costs and lawyers' fees. The other side's costs are not covered if you lose. I will check with you whether you qualify.
